Soñj terms of use and sale

What Soñj does, who sells what, and what happens between the moment you order a poster and the moment it arrives.

1. Purpose

These terms govern the use of the Soñj iPhone app and the purchase of the posters it lets you compose. Installing or using Soñj constitutes acceptance of these terms. If you don't accept them, simply don't use the app.

2. What the service does

Soñj reads your photo library's metadata, dates and locations, and reconstructs your past trips from it. Every trip it finds becomes a poster composed automatically, which you can adjust, then have printed or take away as a file.

What Soñj is not:

  • it is not a location tracking service: the app never records your movements, in the background or in real time. It only reads what is already written into the photos you took;
  • it is not a print shop: I print nothing myself, and I hold no stock. Printing and delivery are handled by a partner, whose role is described in article 6;
  • it is not an archiving service: Soñj does not keep your photos for you, and does not replace a backup.

Detected trips are proposals, worked out from your photos. They can be imprecise, and it is you who confirm them, correct them or dismiss them.

3. No account

Soñj works without an account, without sign-up and without a password. There is nothing to create, and therefore nothing to delete. Your trips live on your iPhone. Uninstalling the app erases them.

4. What is free

The app is free, with no usage limit. Detecting your trips, correcting them, keeping their journal, composing and editing as many posters as you want: all of that is free and will stay free.

Only two things are paid for, and only if you ask for them: the printed poster, and the print file.

5. The two ways to leave with your poster

  • The printed poster, produced and delivered to you. That is a sale concluded with our printing partner, described in article 6.
  • The print file, a PDF ready for the printer of your choice. That is an in-app purchase, collected by Apple, described in article 7.

Neither ever blocks the other, and neither is compulsory.

6. The printed poster: who sells, who charges, who delivers

The seller of the print is Peecho B.V., a Dutch print-on-demand company, and not me. That point matters, so it is better said plainly.

When you tap "Print":

  • the app sends your poster file, then takes you to the payment page run by Peecho;
  • the contract of sale is concluded between you and Peecho. Peecho takes the payment, invoices, applies the VAT of the delivery country, prints, ships and sends you the order confirmation;
  • Peecho's terms of sale apply to that purchase, in addition to these;
  • my role is that of the app's publisher: I compose the file, I put you in touch with Peecho, and I earn a margin on the sale. I hold neither your payment nor your delivery address.

That does not leave you on your own, however. Order tracking comes back into the app, on the Profile page, and if something goes wrong you can write to me at [email protected]: I take it up with Peecho alongside you.

Prints are produced on a 200 g/m² enhanced matte fine art paper, in the sizes offered in the app. Since a print is made for you, a slight variation in tone or framing compared with the on-screen preview is normal: a screen is backlit, paper is not.

7. The print file

The print file is a one-off in-app purchase, with no renewal, priced at €4.99 in France. The price may vary by country, following Apple's price tiers, and the price shown in the app prevails.

That purchase is collected by Apple, under the App Store terms. No payment method passes through Soñj. Refund requests go to Apple, the only contact for billing.

The file is produced before any payment: if making it fails, nothing is charged. Once bought, it is kept in the app and stays available at any time from the Profile page, under "Your print files", for as long as the app is installed. You can save it and share it as many times as you want.

The file is supplied for your personal use. You can have it printed by whoever you want, as many times as you want, but not resell it or exploit it commercially as such.

8. Prices

The prices shown in the app prevail. For prints, they include the VAT of the delivery country and the shipping costs, and are converted into your currency. They can therefore vary from one country to another.

Some destinations are served by none of our products. In that case ordering a print is unavailable, and the app tells you before you start: only the file remains accessible.

9. Delivery, a damaged parcel, a parcel that never arrived

The lead times shown in the app are those given by Peecho, which produces and then ships. They run from the moment payment is validated and vary with the size and the destination.

If the print arrives damaged, photograph it without delay: that is what allows it to be remade. If the parcel doesn't arrive, report it within a month of the shipping date. In either case, write to me at [email protected] or contact Peecho directly: the claim is handled by the seller, and I help you through it.

10. Right of withdrawal

The print. A poster is made from your own photos, at your request and for you alone. It constitutes a clearly personalised good within the meaning of article L221-28 3° of the French consumer code: the fourteen day right of withdrawal does not apply to it. By confirming the order, you acknowledge this. That of course takes nothing away from your rights in the event of a defective or non-conforming product, described in article 11.

The file. This is digital content supplied without a physical medium, whose performance starts immediately. By making the purchase, you expressly request that immediate performance and waive your right of withdrawal, in accordance with article L221-28 13° of the same code.

11. Legal guarantees

For the printed poster, sold by Peecho, you have the legal guarantee of conformity (articles L217-3 and following of the French consumer code) and the guarantee against hidden defects (articles 1641 and following of the civil code). A print that is damaged, badly printed or not what you ordered falls under those guarantees, free of charge, with no further purchase required.

Nothing in these terms sets aside the rights the law grants to consumers.

12. Your photos, your rights

The photos remain yours. I claim no rights over them and exploit them for no purpose other than composing your poster and, if you order a print, having it printed.

By ordering, you warrant that you hold the necessary rights over the images printed, including the agreement of any recognisable people appearing in them. You undertake not to have unlawful or infringing content printed, or content that violates a third party's rights.

13. Your commitments

  • use the app in accordance with the law;
  • do not attempt to circumvent the app's limits, to access other people's files, or to disrupt the service;
  • give an accurate delivery address when ordering;
  • only have printed images you have the right to reproduce.

14. Availability and changes

Soñj is provided "as is". I do what is needed to keep it working, without guaranteeing uninterrupted availability, the total absence of errors, or compatibility with every future version of iOS. Features, templates or sizes may change, be added or be removed.

Since your trips are on your iPhone, the app keeps working offline. Only ordering a print and displaying prices require a connection.

15. Liability

Detected trips are deductions made from metadata, which can be incomplete or wrong. It is up to you to check a poster before having it printed: dates, places, spelling, choice of photos. I cannot be held liable for a print that matches the file you approved.

For everything concerning performance of the sale of the print, liability is the seller's, Peecho.

16. Intellectual property

The name Soñj, its visual identity, its screens, its poster templates and its code belong to me. The templates are licensed to you for composing your own posters, not to be reused elsewhere.

17. Ending your use

You can stop using Soñj whenever you want, by deleting the app. Remember to put the print files you have bought somewhere safe before doing so: they are kept in the app, and disappear with it.

18. Changes to these terms

These terms may be amended. The update date at the top of this page prevails, and any significant change will be announced in the app. The terms applying to an order are those in force on the day you place it.

19. Governing law and disputes

These terms are governed by French law. In the event of a disagreement, an amicable solution will be sought first: write to [email protected].

Failing agreement, any consumer may use a consumer mediator free of charge. For a cross-border purchase within the European Union, the European Consumer Centre France (europe-consommateurs.eu) informs and assists you free of charge. The French courts have jurisdiction.
