Norya terms of use

1. Purpose

These terms govern your use of Norya, an iPhone app that estimates how visible the northern lights are likely to be. Installing the app means accepting them. If any point doesn't suit you, don't install Norya, or uninstall it.

2. What the service does

Norya combines forecast auroral activity, the weather at your location, and the positions of the Sun and the Moon to produce a visibility score from 0 to 100, a verdict in plain words, and an observation window.

The calculation happens on your iPhone. The measurements come from public bodies and weather providers listed in article 9.

3. What Norya is not

This point matters more than the others, so it is said plainly.

• Norya is not a guarantee that you will see anything. A score is an estimate. An aurora can fail to show up despite a high score, or appear despite a low one. No model in the world does better today.
• Norya is not a safety service. Going out at night in winter, in the mountains, on an icy road or far from anywhere carries risks the app doesn't measure and doesn't claim to measure. It knows nothing about road conditions, your equipment, or your physical condition. Your decisions about where to go are entirely your own.
• Norya is not a weather service. It uses weather data, it doesn't produce it, and it replaces no official bulletin or warning from the authorities.

4. No account

Norya asks for no sign-up, no email address and no password. So there is nothing to create, nothing to secure, and nothing to delete on the account side. Your places and your settings live on your device.

5. What is free, what is paid

Free, with no time limit: the score, the verdict and the best window for your location; the 24 hour forecast; the map and the auroral oval; the detailed conditions; the current scientific measurements; the NOAA three day forecast; as many saved places as you want; the widget.

Norya Pro adds alerts, a 72 hour forecast horizon, the map's time slider, detailed solar wind curves, the trend for the weeks ahead, multiple windows and the comparison with the previous night.

The prices shown in the App Store prevail and may vary by country.

6. Payment, renewal, cancellation

Purchases are collected by Apple, through your App Store account. Norya never sees your payment details.

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Cancellation happens in your App Store account settings, and the app links you there from its own settings.
• The 15 day pass does not renew: it stops on its own, there is nothing to cancel.
• "Restore my purchases" reinstates a purchase on a new device or after a reinstall.
• Refund requests are handled by Apple, under Apple's own terms.

7. Your commitments

You agree to use Norya in accordance with the law, not to attempt to circumvent its protections, not to extract its data in bulk, and not to disrupt the alert service.

8. Availability and changes

The service is provided "as is". The sources Norya depends on are public and may be unavailable, delayed or changed without notice, and the app says so rather than hiding the gap.

Features may change. If a feature included in Norya Pro were to disappear for good, you could request a refund of the remaining period through Apple.

9. Sources and attributions

Norya relies on data from:

• NOAA Space Weather Prediction Center: OVATION model, Kp index, solar wind, 27 day trend (public domain data).
• GFZ Helmholtz Centre for Geosciences, Niemegk Geomagnetic Observatory: Hp30 index, under a CC BY 4.0 licence.
• Apple Weather: cloud cover, visibility, temperatures. Weather data provided by Apple Weather.
• Open-Meteo: the weather used by the alert service.
• Apple Maps (MapKit): the base map.
• NASA Global Imagery Browse Services (GIBS) / ESDIS: VIIRS night imagery.

These organisations neither endorse nor validate Norya.

10. Liability

To the extent permitted by law, the publisher cannot be held liable for:

• an aurora you didn't see, or one you saw without Norya announcing it;
• a trip, a journey or an expense undertaken on the strength of a forecast;
• the unavailability, error or delay of a third party source;
• an alert not received, received late, or not relevant.

Nothing in these terms sets aside the legal guarantees you enjoy as a consumer, in particular the legal guarantee of conformity.

11. Intellectual property

The name Norya, its visual identity, its texts and its code belong to the publisher. The scientific data remains the property of the bodies that produce it, under the licences named in article 9. The app is licensed to you for personal, non-exclusive use; it is not sold to you.

12. Ending your use

You can stop using Norya at any time by uninstalling it. Uninstalling erases the data kept on the device. If you had turned alerts on, use Settings → Your data → Delete my data before uninstalling, so the alert service forgets your device too.

13. Changes to these terms

These terms may be amended, in particular to follow a change in the app or in the applicable rules. The date of the last update appears at the top of this page. Any significant change will be announced in the app.

14. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first, in writing to the contact address below.

Failing agreement, you may use a consumer mediator free of charge, or the European online dispute resolution platform (ec.europa.eu/consumers/odr). The French courts have jurisdiction, without prejudice to the consumer protection rules that allow you to bring proceedings where you live.

• App distribution: Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland.

The app itself runs on your device: most of the processing is hosted nowhere else.
